Most attorneys don’t negotiate enough on the front end to avoid court proceedings, and
agencies give a debtor too much time to think without forcing the issue.

These two approaches must be integrated to maximize collection performance. There is no substitute for time in this equation.

An Updated Collection Concepts System
Regardless of your relationship with a collection agency, there are instances when an account needs to be sent directly to a collection lawyer.

Even with the clearest instructions, an debtor can get lost in an agency for 60 to 90 days with no payments and perhaps, not even a promise. Several factors could be the cause:

  • Your agency has no new information.
  • Poor planning and execution.
  • Convincing language to let them keep your account for another 30 – 60 days.

By the time litigation is recommended, you have missed the opportunity of securing your legal position and, if not, the judgment is uncollectible because your debtor is without funds.
